In addition to the standard patentability test of the solution – the patentability test (assessment of novelty and inventive step together with the report and Patent Attorney’s comment), we propose a package patentability test with a supplementary test covering “now”, i.e. a moment before submitting the patent application, answering the question ” what are the chances of being protected by the tested solution? ” and studies in different time sequences.

Patentability testing packages with complementary testing:

To assess the patentability of the solution now and after submitting the application and verify it before the priority period expires, i.e. “is it worth starting procedures in other regions”, we propose:

    1. patentability check now + follow-up examination 10 months after filing 

To answer the question about the patentability of the solution now and before the publication of the content of the application, ie “is it worth continuing the procedure or is it better to withdraw the application before its publication?”, we propose:

    1. patentability examination now + follow-up examination 16 months after filing 

To obtain additional information on the patentability of the solution now and before the expiry of the priority period and before the publication of the content of the application (combination of studies from points 2 and 3), we suggest:

    1. patentability examination now + follow-up examination after 10 months and another 16 months afterapplication 

To answer the question about the patentability of the solution now and before the decision to launch the regional phases of the filed international application (PCT), we propose:

    1. patentability test now + follow-up test 22-26 months after PCT application
